On January 20th Joe Biden’s DHS Acting Secretary David Pekoske sent out a memo directing his department to do a complete review of all deportation policies put in place by the Trump Administration. This memo including a directive that instructed Departments in charge of deportation to start a 100-day pause on certain deportations.
Essentially the Biden Administration doesn’t want to stop anyone from coming in and will not return anyone that illegally entered our country for the first 100 days.
The Epoch Times reports that “Arizona Attorney General Mark Brnovich filed a lawsuit against the Department of Homeland Security (DHS) on Feb. 3 over a memo from the Biden administration that ordered a freeze on the majority of deportations for 100 days.”
Arizona Attorney General Mark Brnovich released a statement saying, “It is unconscionable for DHS to release potentially dangerous detainees into our state, especially when no efforts are made to coordinate with applicable courts and probation departments. AG Brnovich that “as a first-generation American [he] supports the need for comprehensive immigration reform,” but he said, “it cannot be achieved through untenable executive orders.”
The Arizona AG says that he is only asking “the court to enforce the law.” Arizona’s AG claimed that the Biden administration’s policy “puts Arizona public safety at risk.” He continued, “The 100-day pause on deportations includes those charged with or convicted of a crime. Law enforcement officials have told our office they are concerned about whether released individuals are being tested for Covid-19.”
The Epoch Times reports state that “the DHS, DHS Secretary Alejandro Mayorkas, CBP Acting Commissioner Troy Miller, ICE Acting Director Tae Johnson, and Acting Director of U.S. Citizenship and Immigration Services Tracy Renaud, are listed as defendants in the suit.
The suit asks Arizona’s U.S. District Court to ‘enforce the law’ and rule that the 100-day freeze violates federal law. The lawsuit comes after Texas received good news on January 26 from U.S. District Judge Drew Tipton on its case aiming to stop the deportation freeze in Texas.
U.S. District Court Judge Tipton issued a temporary restraining order that successfully blocked the Biden administration’s deportation freeze nationwide for 14 days. Texas was given until February 23rd. Judge Tipton said in his ruling that the Biden administration failed “to provide any concrete, reasonable justification for a 100-day pause on deportations.”
Arizona AG Brnovich says that the lawsuit is “straightforward.” He said, “We basically sued the Department of Homeland Security alleging that their new policy halting deportation is illegal, and it’s also contrary to an MOU [memorandum of understanding] that we have with Homeland Security.”
The suit alleges that “Arizona, as a border state, will be directly impacted by Defendants’ decisions to flout their legal obligations. Arizona’s law enforcement community is particularly concerned that aliens who have been charged or convicted of crimes will be released as a result of DHS’s 100-day moratorium.”
